Studio Fire – Liability Waiver & Release of Claims

This Waiver and Release of Liability (“Agreement”) is entered into by the undersigned participant (“Participant”) in consideration for being permitted to attend, participate in, and/or use the facilities, services, and equipment at any Studio Fire location (each, a “Studio Fire Studio”), whether owned and operated by a franchisee or by the franchisor.

Acknowledgment of Risk
Participant acknowledges and fully understands that participation in fitness classes, workouts, wellness activities, and use of equipment or facilities at Studio Fire may involve inherent risks of injury, illness, or property damage, including but not limited to: muscle strain, sprains, and physical trauma; dehydration or overheating due to infrared heat exposure (temperatures may exceed 100°F); equipment-related injuries; slips, trips, or falls on or near the premises; and exposure to communicable diseases (including COVID-19). Participant voluntarily assumes full responsibility for all such risks, whether known or unknown, even if arising from the negligence of others.

1. Release of Liability
   Participant, on behalf of themselves, their heirs, assigns, personal representatives, and next of kin, hereby releases, waives, and discharges: (a) the Studio Fire Studio at which they participate; (b) all instructors, employees, owners, franchisees, contractors, and volunteers at the Studio Fire Studio; and (c) Studio Fire Franchising, LLC, its officers, directors, employees, and agents, from any and all liability, claims, demands, causes of action, or damages resulting from personal injury, illness, death, or property loss related to participation in Studio Fire activities, whether caused by negligence or otherwise, to the fullest extent permitted by law.

   Indemnification
   Participant agrees to indemnify and hold harmless Studio Fire Franchising, LLC and any Studio Fire Studio, and their respective owners, officers, employees, instructors, and agents, from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities (including attorneys’ fees) arising out of or related to participation in Studio Fire activities.

   Medical Responsibility
   Participant certifies that they are physically fit to participate in Studio Fire offerings and have not been advised otherwise by a qualified medical professional. Participant is responsible for monitoring their own health and well-being and will not exceed their physical limits. Participant understands that Studio Fire does not provide medical evaluations or treatment and is not liable for any health complications or medical emergencies that may occur during or after participation.

   Property and Equipment Use
   Participant agrees to follow all instructions related to equipment and facility use and understands that improper use may result in injury. Participant releases Studio Fire from liability for personal property damage, theft, or loss; injuries related to the condition or storage of equipment; and hazards encountered while entering, exiting, or occupying the studio premises, including stairwells, sidewalks, or common areas.

   Media Release
   Participant grants Studio Fire the right to use photographs, video, and/or audio recordings taken during classes or events for promotional and commercial purposes. Participant waives any right to inspect or approve the final materials or to receive compensation.

   Minors
   Participants under the age of 18 must have written consent from a parent or legal guardian. Studio Fire may restrict minors from certain classes or activities for safety reasons.

   Governing Law
   This Agreement shall be governed by the laws of the state in which the applicable Studio Fire Studio is located. If any provision of this Agreement is found to be unenforceable, the remainder shall remain in full force and effect.
